Terms & Conditions

These Terms govern the purchase, whether online or through other authorized channels, of experiences, excursions, and services offered under the “Alegria Catamarano” brand (hereinafter, “Services”), including, but not limited to, Day Tours and Sunset Tours, private events, personalized experiences, and Gift Cards, with departure and return at the boarding points indicated by the Seller.

We cannot guarantee a response to emails sent on the same day as the excursion.

The Seller acts as the direct carrier and is directly responsible for managing the vessel and providing the service.

2. Definitions

Customer: the entity that purchases the Services

Participant: the individual who uses the Service

Ticket/Voucher: electronic document proving the booking and acceptance of these Terms and Conditions.

Site: alegriacatamarano.it

Crew: captain and onboard staff responsible for operational management and safety.

 

3. Subject of the sale

3.1. The contract concerns the booking and provision of catamaran experiences (excursions/tours) and related services, as described on the Site pages and/or in the Seller's information materials.

3.2 The descriptions of the Services on the Site are an integral part of the contract.

3.3 Ticket types available for purchase
Standard Adult Ticket (Adults aged 7 and over):

Guarantees access on board Alegria and allows you to choose your seat from those available at the time of boarding.

Adult with Panoramic Chaise Longue Seat

Guarantees a spot on a double or triple panoramic chaise longue located on the boat's upper deck. If multiple tickets are purchased within the same booking, the Organizer will make every effort to assign adjacent seats to participants. However, seat assignment remains subject to availability and the boat's organizational and operational requirements and, therefore, cannot be guaranteed. Priority will be given to bookings made in a single order.

Children (3 to 6 years of age)

The Child ticket is reserved for minors between 3 and 6 years of age. Unless otherwise indicated during the purchase process, the same accommodation conditions provided for the purchased ticket type apply to children. Minors must be accompanied and supervised by a responsible adult for the entire duration of the experience.

    

Infants (0 to 2 years of age)

Reserved for children up to 2 years of age. Unless otherwise indicated, the infant is not entitled to a dedicated seat and must be held or assisted by the accompanying adult for the entire duration of the experience. Infants must always be accompanied and supervised by a responsible adult.

 

4. Pre-contractual information and methods for concluding the contract (online purchase)

4.1 The Customer selects the Service, the date, and enters the required information into the booking system.

4.2 The contract is considered concluded at the moment the payment is authorized and the Customer receives booking confirmation via email.

4.3 The language available for concluding the contract is the one indicated on the Site (e.g., IT/EN/FR/DE).

4.4 The Seller may store proof of the contract and the transaction within the limits permitted by applicable law and in compliance with the Privacy Policy.

5. Named ticket, checks, and documents

5.1 The Ticket is personal and issued in the name of the Participant indicated in the booking.

5.2 The Participant must arrive for boarding with:

  • voucher/electronic or paper ticket;
  • a valid identity document, if requested by the crew.

5.3 The Seller may deny boarding in the event of:

  • failure to provide identification;
  • insufficient documentation;
  • conditions incompatible with navigation safety.

6. Prices, taxes, and invoicing

6.1 The prices indicated include VAT where applicable

6.2 Any extra services, including food & beverage options beyond what is included in the purchased Service, may be purchased separately and will be communicated to the Customer directly on board. (see point 8).

6.3 Invoice: Customers who wish to receive an invoice must request it after completing their purchase by sending an email to amministrazione@francapalancasrl.it, providing all the necessary billing details. If the request is not made within the specified timeframe, the Seller cannot guarantee that an invoice can be issued.

 

7. Payment methods and currency

7.1 Payments can be made using the systems available on the Website.

7.2 Bookings made directly at the boarding point are subject to remaining availability.

8. Service Content

8.1 For each Service, the descriptions provided on the Alegria Catamarano website at the time of purchase, as well as the type of tour selected by the Customer, shall be considered accurate.

8.2 Depending on the option purchased, the Services may include different content, time slots, and prices. The applicable price is strictly the one indicated in the booking system at the time of purchase, in relation to the specific option selected by the Customer.

Daily Tour:

Unless otherwise indicated, the ticket price for the Daily Tour includes:
a) the catamaran excursion according to the duration, the indicative itinerary, and the conditions provided for the purchased service;

b) on-board crew assistance;

c) a standard or child's food box/plate, prepared daily and served on board:

The standard menu includes a selection of appetizers (mixed cold cuts, aged cheeses, caprese salad, vegetable pie), a first course (trofie pasta with pesto, potatoes, and green beans), fresh fruit salad, and focaccia. The allergens present are: 1 (cereals containing gluten), 3 (eggs), 7 (milk and dairy products).

The children's menu includes a small pizza, pasta with tomato sauce, potato chips, and a dessert. The allergens present are: 1 (cereals containing gluten), 3 (eggs), 7 (milk and derivatives), 8 (nuts).

The Organizer invites guests with allergies, food intolerances, or specific dietary requirements to communicate them at the time of booking. While every reasonable precaution is taken, the presence of traces of other allergens due to food preparation and handling cannot be excluded.

Last-minute bookings and Box Lunch availability. For bookings made less than 24 hours before departure, the availability of the Box Lunch included in the offer is not guaranteed. In case of unavailability, the Participant may choose and purchase available products directly on board according to the menu list in effect at the time the service is provided.

d) one drink, subject to availability and the terms indicated by the Seller.

Sunset Tour and evening events:

Unless otherwise indicated, the ticket price for the Sunset Tour and evening events includes exclusively:
a) the catamaran excursion according to the duration, indicative itinerary, and conditions provided for the purchased service;
b) assistance from the crew on board.

8.3 The Sunset Tour ticket price does not include any food, dishes, drinks, or consumption other than what is expressly indicated as included. Any additional consumption is optional, can be purchased separately on board if available, and is subject to the prices communicated by the Seller.

8.4 The contents of the food plate/box included in the Daily Tour may vary based on daily availability, seasonality, organizational requirements, and catering supplies. Any images, menus, or descriptions on the Website are for illustrative purposes only.

8.5 The Customer/Participant is required to report any allergies, food intolerances, or relevant conditions at the time of booking or, in any case, well in advance of the tour date. The Seller does not guarantee the ability to accommodate specific dietary requests that have not been expressly confirmed in writing.

8.6 Information regarding allergens and ingredients in food products served or made available on board is provided in accordance with applicable regulations and may be requested from the crew. In the event of severe allergies or intolerances, the Participant is required to inform the Seller and the crew in advance, even before boarding.

8.7 Unless otherwise stated, the following are excluded: parking, transfers to/from the boarding location, meals or drinks other than those included, and any service not expressly indicated.

9. Schedules, boarding, and check-in

9.1 Participants should arrive at least 30 minutes before departure.

9.2 In the event of a delay, the Seller does not guarantee boarding.

9.3 Published schedules are indicative and may be subject to change due to:

  • port traffic;
  • weather and sea conditions;
  • operational requirements;
  • instructions from authorities;
  • safety reasons.

 

10. Itinerary, changes, weather, and safety

10.1 Routes and stops may vary depending on weather and sea conditions, safety, instructions from authorities, or operational requirements.

10.2 For safety reasons, the final decision regarding departure, cancellation, route changes, stops, or early return rests solely with the Captain.

10.3 In the event of cancellation before departure due to weather, technical issues, safety concerns, and/or official authority directives, the Customer will receive a full refund.

10.4 If the tour has commenced as scheduled, any changes or early returns do not entitle the customer to partial refunds.

11. Cancellations, modifications, refunds, and no-shows

11.1 Exclusion of the right of withdrawal:
Pursuant to Art. 59, paragraph 1, letter n) of Legislative Decree 206/2005, the 14-day right of withdrawal does not apply to the Services purchased.

11.2 Booking modifications
The customer may request to reschedule their booking, subject to remaining availability. Rescheduling is not permitted within 48 (forty-eight) hours of the scheduled arrival time.


11.3 Customer cancellation policy:

  • up to 7 days before: the Customer is entitled to a voucher equal to 100% of the amount paid
  • from 7 days to 72 hours: the Customer is entitled to a voucher equal to 50% of the amount paid
  • less than 72 hours: no refund or voucher

Monetary refunds are not provided, except in exceptional cases approved by the Seller.

11.4 Changes during the tour / early return:
If the tour has commenced as scheduled but is subject to route changes, stop adjustments, or early return due to safety reasons, weather conditions, or official authority directives, no partial refund will be provided, unless otherwise decided by the Seller in exceptional cases.

11.5 No-show:
If the Customer fails to arrive for boarding at the scheduled time, they forfeit their right to the service, and no refund or rescheduling will be provided.

11.6 Refund timing and methods:
Any refunds due will be processed within 30 days via:

  • the same payment method used;

or

  • bank transfer.

11.7 Failure to reach the minimum number of bookings
If the minimum number of required bookings is not reached, we reserve the right to cancel the event/service, notifying the customer at least 24 hours before the departure time. In such cases, the customer will receive a full refund of the amount paid, which will be processed automatically to the same payment method used at the time of purchase, without the need for any request. No further compensation or damages will be due.

12. Gift Cards

12.1 Gift Cards must be used within the indicated validity period.

12.2 Withdrawal: For Gift Cards purchased online without a specific date booking, the consumer customer may exercise the right of withdrawal within 14 days, provided that the Gift Card has not already been used/converted into a booking.

12.3 Gift Cards cannot be exchanged for cash and may be subject to limitations indicated at the time of purchase.

13. Conduct, safety rules, and refusal/inability to board

13.1 Participants must follow crew instructions and onboard safety rules.

13.2 No smoking.

Smoking is prohibited on board. Only electronic cigarettes are permitted, in compliance with the instructions of the Captain and crew, and only in designated areas where provided.

13.3 Shoes on board.

You are not permitted to board wearing your own shoes. Footwear must be handed to Alegria staff, who will place them in designated bags and store them in the baskets provided near the pier. Guests are advised to bring flip-flops or footwear suitable for use on board.

13.4 It is prohibited to bring the following on board: narcotic/illegal substances, weapons, explosives, flammable materials, or blunt/sharp objects; it is also prohibited to bring outside alcohol or food/drinks not authorized by the crew.

13.5 It is prohibited to:

diving outside of designated areas;

engaging in dangerous behavior;

obstructing the crew or safety operations.

13.6 The Participant acknowledges that sailing and swimming activities involve risks typical of the marine environment, including:

  • slips;
  • impacts;
  • falls;
  • boat movement;
  • getting in and out of the water;
  • changing weather and sea conditions.

13.7 The Participant agrees to act prudently and fully comply with all instructions provided by the crew.

13.8 Except in cases of willful misconduct or gross negligence, the Seller is not liable for damages or events resulting from:

  • reckless behavior;
  • unauthorized activities;
  • failure to follow instructions.

13.9 The Seller/crew may refuse or discontinue the service (including disembarking at the nearest convenient point, if possible) in the event of dangerous, aggressive, or non-compliant behavior; in such cases, no refund will be provided.

13.10 The crew may refuse to serve alcohol or discontinue service if a guest appears intoxicated.

14. Minors, pregnancy, and health conditions

14.1 Minors must be accompanied by a responsible adult.

14.2 Participation during pregnancy is at the participant's own risk and subject to prior consultation with their doctor.

14.3 For safety reasons, the captain or crew may, at any time, deny boarding or terminate participation if, based on objective circumstances—such as methods of access to the vessel, physical conditions apparently incompatible with the service, or failure to provide requested medical documentation—they believe that participation could pose a risk to the Participant, other participants, or the crew.

14.4 Participants must assess their own physical fitness for sailing and report any relevant conditions (severe allergies, medical conditions, etc.) in advance if required for organizational purposes.

15. Accessibility and reduced mobility

15.1. The Seller informs you that, due to the structural characteristics of the vessel and the boarding/disembarking procedures, the service may not be fully accessible to persons with disabilities or reduced mobility.

15.2. The Customer is encouraged to report any specific assistance or mobility requirements before booking or, in any case, well in advance.

15.3. The Seller will evaluate the compatibility of the service with operational and safety conditions on a case-by-case basis.

 

16. Luggage, prohibited items, animals, and strollers

16.1 Only small items of luggage are permitted (e.g., backpacks/beach bags). Suitcases are not allowed.

16.2 Smoking is prohibited on board, with the exception of electronic cigarettes, unless in designated areas.

16.3 Pets are not allowed unless otherwise authorized by the Seller.

16.4. Strollers are permitted only if they are foldable and compatible with the available space.

16.5. The use of drones during navigation is strictly prohibited.

16.6. Participants are responsible for the safekeeping of their personal belongings.

Except in cases of willful misconduct or gross negligence, the Seller is not liable for:

  • theft;
  • loss;
  • damage;
  • deterioration

of personal items brought on board.

17. Photos and videos

17.1 During the service, photographs and video footage may be taken for promotional and communication purposes for the Alegria Catamarano brand.

17.2 Participants may opt out in advance by notifying the crew before departure.

18. Liability

The Seller declares that they are covered by a civil liability insurance policy related to the provision of the service, within the limits and conditions set forth in the current policy.

18.1 The Participant is responsible for any damage caused intentionally or through negligence to the vessel, equipment, crew, or third parties and may be required to cover the costs of repair or replacement.

18.2 The Seller is not liable for delays, changes, or unforeseen impossibilities due to accidental events, force majeure, weather, government regulations, port traffic, or events beyond their control, except in cases of willful misconduct or gross negligence.

 

19. Complaints and support

19.1 Complaints and requests can be sent to: prenotazioni@alegriacatamarano.it

19.2 The Seller will generally respond within 5 to 10 days of receipt.

20. Governing law, jurisdiction, ADR/ODR

20.1 This contract is governed by Italian law.

20.2 For consumer customers (B2C), any dispute shall be subject to the mandatory jurisdiction of the court of the consumer's place of residence or domicile, provided they are located within the national territory.

20.3 For professional/business customers (B2B), the exclusive jurisdiction for any disputes shall be Brescia.

 

21. Privacy

21.1 Personal data is processed in accordance with the Privacy Policy and Cookie Policy published on the Site; we encourage you to review them before making a purchase.

22. Changes to the Terms

22.1. The Seller may amend these Terms by publishing the updated version on the Site.

22.2. The applicable Terms are those in effect at the time of booking.
