These Conditions govern the online purchase and/or through other authorized channels of experiences, excursions, and services offered under the brand “Alegria Catamarano” (hereinafter, “Services”), including, by way of example, Day Tour and Sunset Tour, private events, personalized experiences, and Gift Cards, with departure from and return to the embarkation points indicated by the Seller.

The Seller operates as a direct carrier and directly manages the vessel and the provision of the service.
Customer: the entity that purchases the Services
Participant: the individual who uses the Service
Ticket/Voucher: electronic document proving the booking and acceptance of these Conditions.
Website: alegriacatamarano.it
Crew: captain and on-board staff responsible for operational management and safety.
3.1. The contract concerns the booking and provision of catamaran experiences (excursions/tours) and related services, as described on the Website pages and/or in the Seller's informational materials.
3.2 The descriptions of the Services present on the Website form an integral part of the contract.
4.1 The Customer selects the Service, the date, and enters the required data into the booking system.
4.2 The contract is considered concluded when payment is authorized and the Customer receives booking confirmation via email.
4.3 The language available for concluding the contract is that indicated on the Website (e.g., IT/EN).
4.4 The Seller may store proof of the contract and transaction within the limits permitted by applicable law and in compliance with the Privacy Policy.
5.1 The Ticket is personal and registered to the Participant indicated in the booking.

6.2 Any extra services, including additional food & beverage beyond what is included in the purchased Service, can be purchased separately and will be communicated to the Customer directly on board. (see point 8).
6.3 Invoice: Customers wishing to receive an invoice must request it after completing their purchase by sending an email to amministrazione@francapalancasrl.it, providing all necessary billing information. If no request is made within the specified terms, the Seller cannot guarantee the issuance of an invoice.
7.1 Payments can be made using the systems available on the Website.
7.2 Bookings made directly at the boarding point are subject to remaining availability.
8.1 For each Service, the descriptions provided on the Alegria Catamaran Website at the time of purchase, as well as the type of tour selected by the Customer, are authoritative.
8.2 Services may include different content, time slots, and prices, depending on the option purchased. The applicable price is strictly that indicated in the booking system at the time of purchase, in relation to the specific option selected by the Customer.
Unless otherwise specified, the ticket price for the Day Tour includes:
a) the catamaran excursion according to the duration, indicative itinerary, and conditions specified for the purchased service;
b) onboard crew assistance;
c) one dish/food box, prepared daily and served on board;
d) one drink, subject to availability and the terms indicated by the Seller.
Unless otherwise specified, the ticket price for the Sunset Tour exclusively includes:
a) the catamaran excursion according to the duration, indicative itinerary, and conditions specified for the purchased service;
b) onboard crew assistance.
8.3 The Sunset Tour ticket price does not include any additional food, dishes, drinks, or consumption other than what is expressly stated as included. Any additional consumption is optional, can be purchased separately if available on board, and is subject to the prices communicated by the Seller.
8.4 The content of the dish/food box included in the Daily Tour may vary based on daily availability, seasonality, organizational needs, and catering supplies. Any images, menus, or descriptions present on the Website are indicative.
8.5 The Client/Participant is required to report any allergies, food intolerances, or relevant conditions at the time of booking or, in any case, with adequate advance notice before the tour date. The Seller does not guarantee the ability to satisfy specific dietary requests not expressly confirmed in writing.
8.6 Information regarding allergens and ingredients of food products served or made available on board is provided according to applicable regulations and can be requested from the onboard staff. In case of severe allergies or intolerances, the Participant is required to inform the Seller and the crew in advance, even before boarding.
8.7 Unless otherwise specified, the following are excluded: parking, transfers to/from the boarding location, meals or drinks other than those included, and any service not expressly indicated.
9.1 Participants should arrive approximately at least 15 minutes before departure.
9.2 In case of delay, the Seller does not guarantee boarding.
9.3 Published times are indicative and may be subject to change due to:
10.1 Routes and stops may vary depending on sea weather conditions, safety, Authority provisions, or operational needs.
10.2 For safety reasons, the final decision on departure, cancellation, route changes, stops, and early return rests solely with the Captain.
10.3 In case of cancellation before departure due to weather, technical failures, safety, and/or Authority provisions, the Customer will receive a full refund.
10.4 If the tour starts regularly, any changes or early returns do not entitle the customer to partial refunds.
11.1 Exclusion of the right of withdrawal:
Pursuant to Article 59, paragraph 1, letter n) of Legislative Decree 206/2005, the 14-day right of withdrawal does not apply to purchased Services.
11.2 Customer Cancellation Policy:
No monetary refunds are provided, except for exceptional cases approved by the Seller.
11.3 Changes during the tour / early return:
If the tour has started regularly but undergoes changes in route/stops or an early return due to safety reasons, weather, or Authority directives, no partial refund is provided, unless otherwise decided by the Seller for exceptional cases.
11.4 No-show:
In case of a no-show at boarding at the indicated time, the Customer loses the right to the service, and no refund or rescheduling to another date is provided.
11.5 Refund processing and methods:

12.1 Gift Cards are valid for use within the indicated validity period.
12.2 Right of Withdrawal: For Gift Cards purchased online without a specific date reservation, the consumer Customer may exercise the right of withdrawal within 14 days, provided that the Gift Card has not already been used or converted into a reservation.
12.3 Gift Cards are not convertible to cash and may be subject to limitations specified at the time of purchase.
13.1 The Participant must follow the crew's instructions and on-board safety rules.
13.2 It is forbidden to bring on board: narcotic/illegal substances, weapons, explosives, flammable materials, blunt/sharp objects; it is also forbidden to bring alcohol from outside and food/drinks not authorized by the crew.
13.3 It is forbidden to:
diving outside permitted areas;
engaging in dangerous behavior;
obstructing the crew or safety.
13.4 The Participant acknowledges that navigation and bathing activities involve risks typical of the marine environment, including:
13.5 The Participant undertakes to act cautiously and fully comply with the instructions given by the crew.
13.6 Except in cases of willful misconduct or gross negligence, the Seller is not liable for damages or incidents arising from:
13.7 The Seller/crew may refuse or discontinue the service (with disembarkation at the first suitable point, if possible) in case of dangerous, aggressive, or non-compliant behavior; in such a case, no refund will be due.
13.8 The crew may refuse to serve alcoholic beverages or discontinue service in case of intoxication.
14.1 Minors must be accompanied by a responsible adult.
14.2 Participation during pregnancy is the sole responsibility of the participant and requires prior evaluation by her own doctor.
14.3 For safety reasons, the captain or crew may, in any case, deny boarding or terminate participation if, based on objective circumstances such as the method of boarding the vessel, physical conditions apparently incompatible with the service, or failure to present any required medical documentation, they believe that participation could pose a risk to the Participant, other participants, or the crew.
14.4 The Participant must assess their physical fitness for navigation and report in advance any relevant conditions (significant allergies, medical conditions, etc.) if required by the organization.
15.1. The Seller informs that, due to the structural characteristics of the vessel and the boarding/disembarking procedures, the service may not be fully accessible to people with disabilities or reduced mobility.
15.2. Customers are encouraged to report any specific assistance or mobility needs before booking or with adequate notice.
15.3. The Seller will evaluate the compatibility of the service with operational and safety conditions on a case-by-case basis.
16.1 Only small luggage is allowed (e.g., backpack/beach bag). Suitcases are not permitted.
16.2 Smoking is prohibited on board, except for electronic cigarettes, unless in designated areas.
16.3 Animals are not allowed unless otherwise authorized by the Seller.
16.4. Strollers are allowed only if foldable and compatible with the available space.
16.5. The use of drones is strictly prohibited during navigation.
16.6. The Participant is responsible for the safekeeping of their personal belongings.
Except in cases of willful misconduct or gross negligence, the Seller is not liable for:

17.1 During the service, photographs and video footage may be taken for promotional and communication purposes of the Alegria Catamaran brand.
17.2 The Participant may object in advance by informing the crew before departure.
The Seller declares to be covered by an insurance policy for civil liability related to the provision of the service, within the limits and under the conditions set forth in the current policy.

18.1 The Participant is responsible for damages caused intentionally or negligently to the vessel, equipment, crew, or third parties and may be required to reimburse repair/replacement costs.
18.2 The Seller is not liable for delays, changes, or unforeseen impossibilities due to unforeseeable circumstances, force majeure, weather, Authority regulations, port traffic, or non-attributable events, except in cases of willful misconduct or gross negligence.

19.2 The Seller typically responds within 5/10 days of receipt.
20.1 The contract is governed by Italian law.
20.2 For consumer clients (B2C), for any dispute, the court of the consumer's place of residence or domicile shall have exclusive jurisdiction, provided they are located within the territory of the State.
20.3 For professional clients/companies (B2B), the exclusive competent court is Brescia.
21.1 Personal data is processed according to the Privacy Policy and Cookie Policy published on the Website; please review them before purchasing.
22.1. The Seller may amend these Terms by publishing the updated version on the Website.
22.2. The applicable Terms are those in force at the time of booking.
